I'm asking for my friend Anne, who has been living with a terrible roommate who continuously harasses her verbally and mentally for several months. For the past 2 months Anne has been trying to break her lease by subletting her room, but finding it impossible to escape this situation.The lease agreement allows for subletting with the landlord's approval. The landlord has been entirely unhelpful, completely staying away from countless requests for help with regards ***** *****'s roommate conflicts, saying he has no responsibility for tenant disagreements. Specifically to Anne's subletting request, he deferred the approval entirely to the roommate.The roommate is determined to make it extremely difficult for Anne in the following ways: - Making absurd requirements for a replacement tenant: 1) must not be Asian because she doesn't like the smell of Asian food, 2) must be a medical worker working full-time most of the time, even during the COVID pandemic - the rationale given is that she wants the whole apartment to herself most of the time - Even when Anne managed to find candidates that met these requirements, the roommate would either refuse to speak with the candidates, or wait for days, even weeks, before responding to them, then turning them down for what seem to be random reasons (e.g. the candidate only works onsite 3 days a week and not all 5 weekdays, or the candidate only has a high school degree even though she meets the income requirements). Besides the said rejection reasons, the long wait that this roommate puts the candidates through is often enough to turn them away.So Anne is in a huge predicament: the landlord is refused to get involved in any way, and even though the lease says he has the power to approve a subletter he is deferring this decision to the roommate, who refuses to approve any replacement tenants at all costs. Landlord has also refused to negotiate, compromise, or release Anne of the rent payment responsibility for the lease's remainder in any way, even though Anne has already offered to let him keep the last month's rent and security deposit.Does Anne have any legal recourse against the roommate or the landlord? This saga has negatively affected her emotional, mental health, and potentially her physical well-being, and she cannot imagine continuing this living situation for the lease's remainder.
