I live in a studio apartment which is a part of COOP. My neighbor upstairs is a woman with little kid and her nephew who watches after the kid during the day. The kid creates the noise during the day time on a daily basis and during the night too sometimes by running , jumping , moving objects or dropping objects. The building is very old and the floors are made of wood so in my apartment it's very miserable to hear these noises the entire day. I can not enjoy my apartment and my peace is disrupted. It's like I'm leaving under children's playground, sometimes his mom invites his little friends to join him and the noise only increases. The situation started in Oct 2019. I had a talk with my neighbor on Dec 24. I came upstairs to talk to her and have a peaceful conversation. It's a Latino lady and she pretended she didn't speak English then she said it's just a baby what can she do and then said she doesn't care about this situation.After that I complained to the building's manager. A few months after a rug was placed and allegedly a padding but that didn't fix the problem and the rug doesn't cover the floor upstairs entirely. Also I assume , the cheapest rug and the cheapest padding were bought I never even received receipts or something like that from the manager as a proof.Then in the duration of the following few months till the present moment because the noise continued at night I had to call the police a few times. Then complained to the building manager again and then again and again. Then in the very end he said something like that :” what are you trying to achieve with this ? She isn't going to move” or something like that. Last Saturday night the noise was happening up to 3 am. I'm not excited to go home anymore and I feel more comfortable being on the street at this point or anywhere outside of my apartment. I bought a camera a few days ago and started collecting evidence of when and what kind of noise is happening. According to Coop rule residents should make every effort to be quiet after 10 pm and the floor should be covered at least 70% plus every resident should have a right for comfortable living. I'm planning to send a demand letter to my neighbor. Questions. 1. Can I sue my Coop for breaching the contract with me and/or for failing to enforce its rules on my neighbor? 2. If I can sue Coop, can I do it in small claims court or where should it be done because I'm not planning to get a lawyer. 3. How much money can I sue my neighbor for( Washington DC max is 10k $)? 4. Can I bring witnesses to the court? 5. What would be considered a strong case for a noise nuisance situation like kinda my story in court? 6. I have video evidence at this point with date and time of recording, I have video recordings on my phone and just audio recordings. Can I bring all of them as evidence? 7. I slept some nights outside of my apartment at hotels outside of my city. Can it also be used as supporting evidence? 8. Can I sue my neighbor and COOP at the same time in a single case and demand 10k $ as a compensation for the damage to my moral and mental state? 9. What are my chances of winning the case? Is it better to sue just my neighbor or COOP or both of them together ? 10. If it's not going to happen at small claims court, how much money can I sue COOP for and what can I demand from the COOP? 11. We never got to the point of discussing this issue with the board of the directors of the COOP ( mostly because of the virus situation). Would it be useful if I request one or it's not necessary? 12. Other recommendations/tips of advice would be highly appreciated. 13. P.S. My other concern is that me at the court as a gay male adult vs single mom female with a little kid may not look beneficial to my case in front of the court but the lady should control her kid or take care of the soundproofing as well as obey quiet hours regime at night which she doesn't and justifies it with her little kid.
