“Tenant shall notify Landlord in writing 6 months in advance of desire to exercise the option to lease for an additional 5 years. The right to exercise the option is conditioned on the fact that all rents have been paid as agreed and is at the discretion of the Landlord if there has been a breach in agreement and tenants so notified.”Current original lease is CPI 3% increase. Landlord wants 4%-6% CPI increase on the option to renew. Questions; When you renew a lease, everything should stay exactly the same except for the base rent, which either is at fair market rents, or at the stipulated fixed price. So we do not see why the landlord has a case to increase the annual increases, and to start charging for Annual Property Tax, when that is not what was agreed to in the existing lease.Could Tenants argue that the intent would be that the renewal would be at fair market rates. They could be determined by figuring out what is fair market, and then apply the 3% increases per year as per the existing lease, or the 3% could just continue into the extended term.Questions: Landlord wants to Tenants to pay for Real Estate Agent commission fees Per Landlord: Tenant is responsible for renewal commission fee at 5% of the entire 5 year lease term.Questions is this even legal? Tenants disagree with this, as the existing lease says both parties pay their respective brokers, and there was only a listing agent involved in the previous lease, therefore that should govern moving forward as well. … read more
