I'm currently fighting an UD that is brought on with no cause of action and court is currently set for the second week of August in Hayward (I demanded a jury trial so the date may change)? Anyway i'm starting to get overwhelmed and confused battling the Landlord's attorney by myself as I have many issues to bring up but need help with paperwork and civil codes etc. here is a list of what I need help with: -landlord planned and intentionally stole my emotional support animal / service dog in training from me in my home with the help of her former tenant (police said it was a civil matter and she and former tenant have possession of my dog still) -landlord has entered the premises multiple times with out notice or established reasons -landlord has verbally assaulted me making me fear violence -two days ago I rec'd a notice from pg&e stating I needed to establish an account to avoid service interruption and that services have been left on as a "courtesy" -landlord lied in the complaint stating I never had permission to live there and that she had no knowledge of me living there, calling me a "tenant at sufferance" -rec'd multiple text messages and emails containing "30 day notices to leave" -rec'd three day notice with a rent increase from $0-$1000 with out any prior notice of rent increase (Landlord paid herself the rent each month by writing herself the monthly mortgage check from the former tenants special checking account that only she has access too). -complaint states former tenant had vacated the premises and I was still in possession of property with out permission; this was verified on June 19, filed on June 28th and served to me on July 2nd. Former tenant did not move out until July 2nd after receiving help from Landlord to steal my dog. * landlord in my (now) ex-boyfriends mother* I feel like this eviction is retaliatory and discriminating if not full of harassment and intentional emotional distress. I would like to keep living in the house because rent was/is only $1000/month and that is all I can afford right now. Former tenant is moving to a new home and is not wanting to keep living in that house so there shouldn't be any reason to not allow me to rent the premises . The house is at***** Livermore, CA 94551. Any advice is greatly appreciated! I know I should have filed a demurrer as the eviction has no cause of action but I ran out of time trying to put it all together on my own. If anyone at your office could represent me or partially represent me I would be so grateful as I can only find lawyers that want $4000-$7000 and do not seem interested in anything but money.… read more
