I was in a 6 month lease that ends the end of this month. The apartments I live in are smoke free, in the lease and everyone signs it. I am 68 years old, I am chemically and environmentally sensitive. I have lost some air flow in my smaller air ways. I can't be around smoke, fumes, chemical or dusts. I have carried a mask for 6 years before the pandemic to protect myself . The people in apartment next to me began smoking and vaping about 6 weeks ago. It comes into my bedroom heavily. I had to stop sleeping in there. I have been working with apt. manager and they have made effort to contact tenants and have them stop. Numerous times. They haven't been successful with there efforts and due to pandemic can't evict. The apartment right down the hall was vacated on Feb. 28th. I asked if I could move in there and apt mgr said yes. I did ask that the apartment not be painted as I would have to wait another 7-8 days to move in. They were fine with that. I was told early last week that the cleaners would come in over this past weekend. and that I would probably get the keys on Monday. They never said let's go into the apartment so you can see it and in my frame of mind I didn't think to ask. I was told the apartment was ok. The couple had a dog. I don't go out everyday due to pandemic but I did notice a couple that all the windows were open especially after cleaners went in on Saturday. But they may have been open before Saturday. I did get keys yesterday. I then went in and paid the rent for new apartment which set in the motion the transfer to this apartment and in essence signed the lease although I never did any online or in person lease. I went in double masked and took mask down for a minute and did smell something but thought maybe the dog but didn't have my mask off long enough to know. I did some cleaning for an hour with my double mask. I shut all the windows last night before I left. I went in this morning and realized within a few minutes that it was smoke. I left and went back to my apartment. My lung react quick and I began coughing and clearing my throat which is what happens when I'm exposed to something that affects my lungs. I called the apartment mgr and when I spike with her I said I couldn't move in there. I was sorry for the trouble I'd put them through but I couldn't. Was there a way I could stay in the apartment I'm in. I'd just sleep in living room. I said I'd pay fees or whatever if it could happen. The apt mgr spoke to her mgr and I did talk with her and she said that I couldn't. That I would have to move into the apartment down the hall and that if I broke my lease I would still have to leave the apartment I'm still in and was to move out of the next few days. She told me that I was exhausting to her and the staff and I know I've been a challenge but I need to breathe and I'm not the one that started the problem in the first place, even though I know they made effort to do something about it. I have been in this complex for 3 years and have moved within the complex no problem. I have always paid rent on time and not caused any problems. I'm also very neat and clean and they know this, that I take care of the space I'm in. I'm waiting to hear from the main manager to see what she says. She said that they've never reversed a transfer that it is timely and costly and I'm sure that true. I would be willing to pay money for it to happen. After our call I realized that I wasn't offered to go to the apartment to see it before I paid rent, and I feel the windows were opened because they knew there was a smell and tried to air it out. The manager of the complex has been nice, the main manager has made me feel like I am too big of a problem and I am quite devastated that I am in this situation and that my almost desperation to move to a space where I would feel safer led to me not being mindful enough to ask to see the apartment and get a sense of it.
