Yes. You could file a motion to stay. The Motion for a Stay of Execution is only granted when a judge feels a showing of extreme hardship exists (ex; would become homeless). The motion is proper to use only after your landlord wins the unlawful detainer (eviction) case against you, and you want to delay your eviction. Therefore, you should only use this packet if you have already filed an answer, lost at trial, received a Sheriff's Notice to Vacate, and you need more time to move out because of an extreme hardship.

You must file this motion immediately to allow time for the Judge to read and sign the order, and for you to have your landlord and the sheriff served. If there is not enough time then you could try to ask the court to expedite the procedure, however, that is at the discretion of the judge. If the judge does not view the motion before the eviction date then you have very little recourse as the sheriff will proceed with the eviction on the scheduled date.

If you need further assistance, just let me know.

Story... My girlfriend and I moved into an apartment on
My girlfriend and I moved into an apartment on December 28, 2017 and moved out March 31, 2018 as to transfer to a bigger apartment. While waiting for the return of the security deposit from the past apt, the Leasing Manager calls and emails me saying there is a balance the from the prior apt. According to the Leasing Manager, it is standard that property charge a cleaning fee, repaints, and has a carpet cleaning regardless of the state of the apt. The property does it every time a resident moves. Additionally, we were charged rent for April 1st & 2nd because we could not turn the keys in until Monday morning (April 2nd) due to no one being in the office (Easter Holiday). As you are reading this, it is of course safe to assume that we would like a legal opinion on the matter. This is especially so as we live in another apt on the property and really prefer not to deal with this again when we have a departure from the new apt. … read more
