One of my commercial landlords is now charging me a late fee

One of my commercial landlords is now charging me a late fee if I don't have the rent in their office by the 5th of the month. It is in the lease that there is a late fee, however, they have received the payment after the 5th previously. They have accepted payment without charging a late fee up until now. I know that they have modified the lease by accepting a late payment without charging a late fee, but I do not know the statute. I'm in CA. Can anyone help me out?
