can a landlord deliver a unit later than stated date and refuse to give security deposit and rent paid back. We have offered several solutions including keeping a portion, assistance with renting the unit at a later date to no avail. Any other ideas to get out of this agreement with this dishonest individual.

Landlord delivering the premises late is a breach of lease. Tenant is entitled to cancel without penalty, and if landlord is holding a deposit it must be returned. If not returned, tenant may sue in small claims court to recover!

I need to get out of a lease for an upcoming condo and need assistance. We are unable to speak with he landlord and he is not delivering the unit when promised. He has 4000$ of mine and not willing to give it back. Any ideas for a letter that would potentially prevent this from having to go into small claims court. I need to find another lease ASAP and can't until released.

You can send a letter demanding immediate return of the deposit due to breach by landlord. Give a 5 day deadline under threat of lawsuit. Most landlords will comply.
