My name is ***** ***** wife and I signed a three year lease agreement with our landlord Aaron from June 2015 to May 2018. We paid a deposit in amount of $5,350 to reside in the property at 9409 Kings Parade Blvd. In October, we experienced a heavy wind and rain, a tornado, which did damage to the roof and windows to the property. We contacted the landlord the same night of the tornado to inform him of the damages. My family stayed at a hotel the same night due to the power outage and broken glass throughout the home because of the tornado. Nonetheless, Aaron assured us that the damage would be repaired as soon as possible as he had to go through the HOA. A couple months passed by and the damages that occurred in October were never repaired and became extremely cumbersome. We experienced heavy rain and snow amongst the days of October, November and December. The up and down weather changes from heat to cold winds then snow then heat caused the electricity bill to skyrocket as the home was extremely exposed due to various broken windows. The walls began to build huge wet spots and spread throughout the home and into the carpets and hardwood. The carpet and hardwood began to look deteriorated from moisture, in addition to dirt constantly intruding through the broken windows. Our cleaning lady Alicia which typically cleaned twice a month had to clean twice as hard, therefore charging us more, in November and December. But as great tenants, residing in the home and still paying $1,800 a month in rent, we began to do some repairs ourselves as it was beyond bearable to live in a home especially during the holidays, Thanksgiving and Christmas, with so much damage. Please note, we were extremely patient with the landlord because he expressed to us that he was awaiting the HOA to begin the repairs. We did not ask for a credit of any kind for rent paid in November and December. We just simply wanted our home back moreso. In the month of December, we began repainting the walls on the first and second floor, cleaning carpets on the third floor, and refinishing the hardwoods on the second floor and first floor. In the last week of December, HOA finally repaired the roof. On December 31st, I contacted Aaron to let him know that additional damaged have occurred to the properties, assumingely, as a result of the “repaired roof”. On January 1, Aaron arrived to the properties and reviewed with the water damages, beyond the damages that occurred originally, rapidly spread throughout the home from the third, second and first floor. Damaging the carpet and hardwoods worse than before. ERX who was responsible for repairing the roof, did not secure the roof properly. My family and I had to move out of the home because the damages were just that bad. Note, we still paid rent on the 1st of January to the landlord! ERX sent a mitigation team into the home to assess the damages that occurred. After a week, they began repairs by tearing up hardwoods and carpets, cutting holes in the walls throughout the home - therefore turning 9409 Kings Parade Blvd into a workstation as we were not the only townhouse that was damaged from the unsuccessful roof fix. As time passed, one of the ERX specialist informed me that the repairs would not be finished until late March. AWESOME! WHAT DO WE DO NOW? HOW CAN MY WIFE AND I RAISE TWO BOYS, 7 AND 9 YEARS OF AGE IN A HOME WITH CONSTANT TRAFFIC IN AND OUT OF THE HOMES FROM STRANGERS, RIPPED UP HARDWOODS, ETC? On January 31st, my wife and I emailed Aaron the following, “Due to the many repairs that have yet to take place in relations to the tornado that caused damage to the roof and windows of the rental unit my family and I currently resides, we, the tenants of 9409 Kings Parade Blvd, would like to request a credit in the amount of $1,250 for the month of January for rent paid in the amount of $1,800 or an agreed termination of lease effective February 5th and the return of the paid deposit in… read more
