The property management company double charged my account

Customer Question

The property management company double charged my account for rent and then subsequently double reversed the payment. I was unaware of the mistake and spent the amount of money they credited my account. It was in secondary account that is not monitored regularly. They are now giving me 30 days to pay it back or they will start eviction proceedings. What are my rights?

Legally, the error needs to be fixed and the single payment made. The mistake is the company's, and not yours. In this situation, it may not impose time limit but has to be reasonable. That does not mean an indefinite pass to pay but 60-90 days would be reasonable since it was their error. You may alert them or have a lawyer do so locally.
