We signed a year lease and wired a deposit for a home in AZ
Hi! We signed a year lease and wired a deposit for a home in AZ starting on June 1. The landlord gave the current tenant 33 day notice to leave the property as he is on a month-month lease. The current tenant became very upset with the landlord and threatened to sue him as he was putting in a high risk category by requesting he move during COVID. We told the landlord that we were willing to be flexible with the move in date pushing it back to July 1 or July 15 to allow him more time to find another home. The current tenant is now saying he will not move out until COVID is over. In the meantime, the landlord has said he has to break our lease and requested wire instructions from us. We currently own our home. Needless to say, this did not sound right so I contacted the AZ Tenants Advocates to get some advice. The rep that I spoke with said, the landlord is still on the hook even though he was claiming that we didn't have a legit lease as he didn't sign it. I guess, according to AZ law, it is deemed signed once it is submitted via email. At any rate, he accepted our wire as well. At any rate, we were advised not to get the wire back until we had secured another home. (There are currently only four available at this time, but they don't work for us as we are a family of seven.) We have signed another lease effective June 1. We requested for the wire to be returned, but now he will not return without us signing off on a legal document stating that we will not sue him. We are not planning to sue him, but it was recommended that he should give us something for our troubles. We are now stuck moving twice and have to pay thousands to store our belongings as the new lease comes fully furnished. It is going to cost us roughly $7,000 more. I just called Fidelity to report this. The rep stated that we need the funds back before signing anything. Clearly, he does not seem trustworthy and may go back on his word.
