how do i write a letter giving someone permission to use my trademark and yet protect my trademark.  This is NOT real Estate!

Do you have a federal trademark registration for your trademark?

If not, what length of time have you been using the mark?

Is the mark used in multiple states?

Customer: replied 6 years ago.
No. I have had the trade mark sense 1999 registered in the State ofTexas only.

Thank you for your response. The simplest way to resolve this issue would be to draft a basic license agreement with the Dealer that states that he or she can use the trademark for limited purposes outlined in the agreement.

However, there should be specific langauge within the agreement that you are not assigning any ownership rights to the Dealer with respect to the trademark.

Further, there should be specific language that states that you will remain the sole owner of the trademark despite the Dealer's use of the mark.
