My category is f2a "under 21 child of LPR". We got an RFE for i130 back in 2019 for untimely registration of borth for which we provided enough evidences and got it approved. For Ii485, which was filed August this year, the RFE says "You have provided a secondary evidence and/or borth affidavit as proof of birth record for the applicant. However, the evidences you submitted are not enough. " they have asked us to send school records or any official records showing the birth date. The confusing part is that we sent my birth certificate along with the english translation (NEPAL) which is the primary evidence. I went through the checklist and there is nothing on the secondary evidence unless primary evidence is not present. Since we have submiited (double checked) the birth certificate, its translation as well, I am not sure what the RFE is asking for (we never sumitted secondary evidence when we already have the primary evidence and sent it )… read more

Need help. I have received a 'Request for Further Evidence'
I have received a 'Request for Further Evidence' from the USCIS about my sibling's pending i130 application. USCIS says birth certificate was registered many years after birth, which is a very common practice in Bangladesh. There is no other secondary evidence such hospital record as we were all born at home. Until recently, registering a birth in Bangladesh was not a legal requirement. So we all collected/registered our birth certificates at the time of applying the i130 in 2013. At that time, we also enclosed two affidavits confirming birth date and parents name. However, USCIS seems to have missed those affidavits. I still have the original affidavits dated from 2013. Shall I send them again? We can get letters from our school but these would be dated now as the schools back in the days did not keep any records. We can get certificates from Mosques Imam (Religious priest for Muslims) but then again these will be dated now. UCSIC is giving emphasise on old documents dated within the time time of birth. This is not possible as we were born 30 years back and record keeping was not practised those days. Please help!… read more
