I need help with immigration lawyer. I arrived the US onI arrived the US on Dec/15/2018 on J1 Scholar Visa for Research fellow program in ***** ***** University (Jan- Dec 2019). complete the program earlier, so I got a shortage in my visa status (Jan- Oct 2019). In October I file case (change Visa status to B2 for 6-month Nov 2019- April 2020) which was rejected because in correct fee, later on I submit the right fee, so they start working on it, Receipt Number YSC2090072301. During this time (Nov- March) I was in medical residency program interview season which ends by me get acceptance in Internal medicine program residency, start in 15 Jun 2020. I need to apply for J1 visa for medical residency. I am currently in US with bending visa status. My program ISSS highlighted 2 points regarding my visa status:A) The period between the end of my previous J-1 and the filing of the application for a change of status (from J-1 to B-2).GW told me I have to leave US by end of October, and No 30 day grace period as my program get a shortage. Regarding late file: I file form I-539 before end of October and the first 2 files was rejected, Here is the 2 cases response by USCIS: 1) On October 30, 2019, we rejected Receipt Number YSC2090033412 2) On November 21, 2019, we rejected Receipt Number YSC2090054994B) 2-years home residency requirement (or 212e rule) My university concern about this rule if it may affect me in filing the change of status to J1 ,this is what they wrote: (The 212e prevent you to change from one nonimmigrant status (J-1 for example) to another nonimmigrant status (B-2 for example) within the US. That is why your current application filed in December may be denied. However, now you are seeking to get a J-1 status, so the same as before, no change)I just called USCIS again regarding this issue and they told me: I was ok to file another case with the correct fee my stay was legal as already I have a case. I can file change status to J1 and withdraw the previous one.I think I have no choice except do change visa status, as there is no clear idea about when I can travel to Saudi Arabia, also no clear idea when Saudi Arabia will open international flights to US again.My concern about the time during rejected 2 cases (Nov-Dec 9th) if that will affect me in current pending or new COS to J1 Is there a way to expedite the COS to J1, Specially my residency will help fight COVID19.
