So I recently graduated with a PhD in Electrical (May 2019) and have been involved with a startup (part-time CPT and now full-time OPT after graduation). I am being offered a role at another startup who is willing to apply for an O1 visa. I plan to register both startups on my OPT and continue through 24 months OPT extensions as both are related to my major. Until now I thought, going the O1 route for green card exempts you from going through H1B or EB1 process. Since I have Indian citizenship, H1B doesn't seem suitable due to long wait periods. So, I am wondering: 1. Next April, should I recommend the new startup to apply for H1B, O1 or EB-1 considering my OPT expires on July 2020 and I may have applied for OPT extension already? Is it safe to apply for H1B, O1 or EB-1 before I do my OPT extension? Does applying for any of these (esp. O1 and EB-1) restrict international travel? 2. Also, would you know how much each process (H1B vs O1 vs EB-1) would cost (including attorney fees) to both employer and employee? The reason I am asking is that my compensation is dependant on whether I pay all fees by myself or let the startup handle it? 3. Is getting a green card from O1 faster and independent of getting one through EB1? Is it better to do O1 or H1B before applying for green card or I can do it directly from my OPT status? … read more
