I have a question on my H1B visa. Company A filed H1
Company A filed H1 petition was vaild through February 2022. As Client A has ended the position in February, 2020, Company A had sent a withdrawal notice to USCIS but I still see it approved and see no change, on my USCIS account.Company B filed H1 in regular processing and I received the receipt(Notice Date: 3/31/2020 - this date is well within 60 day grace period). But the project for which Company B filed, has been ramped down. This company is looking projects for me now.I now have an offer with Company C.Can Company C file another petition in regular processing(as premium has been suspended) based on Company A's petition as it was supposed to be valid through February 2022, without conflicting with Company B's petition?Can I consider my status to be valid, in the currnet COVID-19 situation?Is the grace period extended from 60 days to 180 days? … read more

H1b. No I am from India - H1b I joined company A ( from X)
no I am from India - H1bI joined company A ( from X) in July 2018, extension and transfer was filed by company ATransfer was approved and Visa Extension was untill 3rd Nov 2018(I also have a approved i797 with Company B which was approved on Jan 2019 - with validity 01/04/2021, i never joined the company B as by the time my visa got approved they did not have a job, company B has not withdrawn the petition )Company A again Filed and extension on 22nd Oct with the SOW/PO that was valid untill 3rd Nov 2019 ( as client was yet to share the new sow and Po - client gives only 3 months sow/po at a time )Uscis - sent RFE asking for extended SOW and PO in Feb 2019Company A submitted SOW/PO that was valid untill March 16 2019 ( i have completed assignment on 16th March 2019 with the client for which PO and SOW was submitted )My Current Visa extension/amendment from company A got approved on 2nd May 2019 - but backdated i.e 16 March 2019 ( means Uscis gave extension untill March 16 2019, I94 untill 26 March 2019) soft copy attachedCould you advise what options I have , some query I can think of and need you suggestionAny other if you can think will help me of please let me knowA.how many days I can stay in usa now ? 60 days from March 16 2019 or 60 days from 3rd may 2019 - the day attorney received the email ? or the day i will receive the copy of notice ? or 2 weeks from the date attorney received email or 2weeks from the day they receive hard copy?B. If company B ( the one with approved i797 until 2021) get me onboarded by say 15 or 20 th May 2019 - can I directly get onboarded or I had to leave the country and get visa stamped and come back ?c. I have employer C who found job for me , he filed LCA on 8th May 2019 and post LCA certification (tentatively by 17th May) he will initiate transfer in premium? Is this viable with my present situation ?Employer C attorney states that 60days will be counted from the day of receipt of the approval noticeNote - I have approved I140 from Employer A - approved on 23rd April 2019If I move offshore - can any other employer file my h1 visa , if yes will that be out of cap ? I am back. I have 3 questions i need answers to Here is the
i have 3 questions i need answers to Here is the prelude of my situation followed by a set of questions:I was employed with Taaratech LLC between March 2013 and Nov 2017 on a H1B( first for 1 year and extension for 3 years till dec 2017). I have a approved I140 cert through Taaratech with the 2009 Nov priority date ported over( see I140 approval copy attached).After waiting for 3 years for my visa number to be available and with no movement, I took an offer with Kforce and transferred my H1B in Dec 2017 and have my H1 valid till 2020(see approval notice I797 with Kforce). Kforce applied for my labor cert on day 1 and I have an approved labor cert with them i received on Aug 1 2018. I am between assignments in my 60 day grace period and Kforce said they will file for I140 once i am back on an assignment(which is reasonable).my main question is as follows:1. if i move to another company through a H1 transfer to a company who does not do GC processing (for example TCS), can i move back to Taaratech when a visa number is ***** and current and file for my AOS? I dont mind filing another H1 transfer back to Taaratech if needed.2. say for some reason i choose to go back to india or canada and work there. can i do counselor processing to file for my AOS when my visa number becomes available? should i maybe come back to the USA on say a H4 and file for it?(my wife had an approved H1 in march 2018 and currently having an amended petition for her new role)3. after the 60 day period(after september 11 2018), Kforce is telling me i can still stay in the country(upto 180 days) but can join a new contract only with an approved H1B which they have promised to apply in premium processing. this sounds risky and i definitely dont want to be out of status and considering switching to a H4 status as my wife has an amended H1 petition pending(previously was approved till 2020 but she had a job title change recently needing an amended petition.I think my bot***** *****ne is I dont want to restart my GC process (Labor is laborious!) everytime i do a H1 transfer and would like to reuse the approved application with Taaratech. … read more
