I am hoping to talk to a lawyer. My re-entry permit application (I am a green card holder) just got denied. (Actually, it's my Mom's)

Lawyer's Assistant: What state are you in? It matters because laws vary by location.

Well this was a federal application But I live in California. But state laws should not have impact on this

It is extremely rare for a U.S. Lawful Permanent Resident to be denied a Re-Entry Permit. What was the reason for denial?

well, that's the problem. I don't know the reason for denial yet as the formal letter has not arrived yet. Can you tell me what "typical" reasons for denial are? We did the reentry permit application through a lawyer so I assume there should not have been "basic technical" errors (e.g., forgot to sign, etc.). The application was filed while she was physically present in the US. With those factors in mind, what could some other reasons have been? E.g., does the green card holder's previous track record of the amount of time spent in the US be taken into consideration. Specifically, could they have denied the reentry permit because she has only spent 40% of her time in the recent 5 years in the US? Is it typical for denials to be based on such substantive judgment calls by USCIS officers? Thank you!

Typical reasons for denial are that something was marked incorrectly on the form. Also, if she was not in the U.S. to get her fingerprints taken, that's another reason for denial. It would not have been denied just because she wasn't spending enough time in the U.S. We might want to wait a few days to get the denial letter.

I received the denial letter today. It claims that my Mom missed her biometrics appointment, which is not true. We have a stamped biometrics appointment form, proving that she got fingerprinted 4 months ago. Does the Motion to Reopen work? How long does it take to get processed?

Yes, it should work. I would say 3 to 5 months is what it can take to process. So file is quickly!

Do you think it would help to go to an Infopass appointment with USCIS, at least so that they can check if the fingerprints are in my Mom's file? Or would they not talk to me since I am her daughter vs legal rep? I am worried about waiting 3-5 months for a Motion to Reopen answer since I don't know whether the technician that took her fingerprints just plain did not save them or if he saved them and just forgot to take some other step to send them through.

They most likely would not talk to you because you are not a legal representative. I mean you can try, but there is no guarantee.
