Los residentes permanentes no pueden solicitar a los hermanos que vivan permanentemente en los Estados Unidos. Para completar con éxito el proceso, usted) debe enviar: Un Formulario I-130 completado. (Nota: Usted no necesita presentar un Formulario I-130 separado para el cónyuge de su hermano o hijos solteros menores de 21 años de edad). Bienvenidos y gracias por usar a nuestro servicio. Yo soy Guillermo Senmartin, un abogado licenciado en EEUU. Tratare de ayudar si la ley tiene solución. Solamente le pido dos cosas. 1) Si es mala noticia, no me culpe porque yo no tengo control sobre lo que dicte la ley y la verdad siempre es útil para evitar los ladrones en la calle que se aprovechan de la desesperación de uno para cobrarle miles de dólares en cosas que o tienen posibilidades mínimas, o no tienen posibilidades. 2) Dejar una opinión/valor positiva de mi servicio. Su pregunta no se cierra simplemente porque deja una opinión positiva. Estaré aquí para responderle sin cargo adicional.

Básicamente, para una persona obtener la visa de turista para poder visitar por un tiempo tiene que comprobar que no se va quedar ilegal. Para hacer eso tiene que demostrar porque viene, cuánto tiempo necesita, porque necesita ese monto de tiempo, y como se va mantener si no puede trabajar legalmente. También, la persona tiene que comprobar que tiene muchas conexiones fuertes a su país. Por ejemplo, que tiene un buen trabajo por largo tiempo por buena empresa que normalmente no lo abandonara, que tiene propiedades, familia cercana, etc. etc.

Es decir si la persona es muy joven o muy anciana, no tiene muchas raíces en su país, es muy difícil de comprobar que si viene a los Estados Unidos, no se va quedar ilegal.

Si la persona que invita escribe una carta de invitación, lo que eso ayuda es a comprobar porque la persona viene y como se va mantener sin tener que trabajar (que no puede trabajar). Se apoya la razón por la cual que viene la persona y brinda la casa y comidas. Pero entienda que la carta de invitacion no es importante. Es decir que uno puede tener miles de invitaciones de Ciudadanos y Residentes y eso no tiene mucha importancia. Lo que tiene importancia es lo que uno tiene en su pais para atarlo y garantizar que va volver.

También si la persona tiene mucha familia acá y muy poca en el pais natal, o va traer con ellos toda su familia cercana, entones no ayuda porque tiene menos cosas en su país para asegurar que va volver.

Para aclarar, la visa B-2 no requiere ni carta de invitacion ni el I-134 Affidavit of Support, pero los dos pueden ayudar, la carta para comprobar porque viene y el I-134 para demostrar que tiene apoyo que no va trabajar ilegalmente.
