My H1B approved and started on October 2015, I had to return

JA: Hi. What seems to be the problem?
Customer: Hi,My H1B approved and started on October 2015, I had to return to india in Dec 2015 on family emergency and got H1B stamped. I worked from india till April and gave resignation as I couldn't travel back to USA. My company withdraw my petition. AM I cap exempt now, will I be able to get my h1b transfered in order to return to Usa? Please help me, it will be big helpThanks!!!

So sorry for the delay. Yes you are still cap exempt because you were counted against the cap in the last 6 years.

You can have a new employer petition for you and you do not have to wait until April 2018 to be counted in cap.
