No tenga miedo de responder. No se le cobra por pregunta ni por respuesta y tampoco no le voy a pedir informacion privada como su nombre, etc. Asi que tranquilo. ¿Cómo entro usted a EEUU? ¿Ilegalmente o con visa? ¿Cuál visa? ¿De cuál país es usted? El problema es que si usted entro al país ilegalmente, no puede cambiar su estatus dentro de los estados unidos. La única excepción es si usted fue amparado por la ley 245(i) en que básicamente usted tuvo una certificación laboral, I-130, o I-140 entregado por usted antes del 30 de abril, 2001 y si estuvo dentro del país el 21 de diciembre 2000. Asilo político es una opción si usted tiene un gran miedo que si vuelve a su país, va ser perseguido por su nacionalidad, raza, opinión política, religión, o por ser miembro de un grupo social especifico y definido. Para solicitar asilo, uno tiene que pedirlo dentro del primer año de estar en el país. Si, no, puede pedir Withholding of Removal, pero eso es mucho más difícil para comprobar que asilo y no le da la residencia como asilo, simplemente no lo echan del país. Y también, otra opción es Cancellation of Removal (la ley de los 10 años) que previene la deportación si uno puede comprobar que tiene más de 10 años en le país y que también tiene un Ciudadano o Residente que depende de ellos y si esta la persona deportada, el Ciudadano o Residente va sufrir EXTREMADAMENTE, y eso tiene que ser algo más que sufrimiento emocional o económico. Tenga cuidado porque si pierde, queda deportado.Si usted está casado o se casa con Ciudadana (por amor, no por papeles), puede tramitar dentro del país un I-130, pero al aprobarse esa petición, usted tendría que salir del país para tramitar el resto. Y si usted sale del país para poder hacer los trámites por afuera, puede ser que no la dejan entrar por 10 años. Y el único amparo que existe para dejarle entrar de nuevo es la I-601. Con este waiver se tiene que comprobar que si a usted no lo dejan entrar de nuevo, su esposa ciudadana o residente o sus padres ciudadanos o residentes van sufrir extremadamente. Este sufrimiento tiene que ser más que sufrimiento emocional o económico. Así que muy pocas personas arriesgan salir del país para tramitar afuera, y desafortunadamente, como le dije, usted no puede tramitar dentro de los Estados Unidos porque entro ilegalmente.Existe unos sitios con más información del I-601 pero algunas están en Ingles. Solamente es un cambio en proceso. Es decir que antes, con el I-601, uno tenía que solicitar los perdones y salir para tramitar desde afuera y eso se demoraba más o menos 15 meses o más mientras esperaba afuera y si se lo negaban, entonces no podía regresar por 10 años. Lo que cambio del I-601 al I-601A es que puede hacer parte del proceso dentro de EEUU y obtener una pre-aprobación del perdón. Con esa pre-aprobación, uno tiene que salir del país y hacer cita con la embajada o consulado de EEUU. Se supone que sería solamente unos días que estará afuera y si no tiene nada más en su antepasado, solamente haber entrado ilegal, entonces le debe dar la visa para regresar. Lo siento muchísimo pero las opciones son pocas en este momento. Si tiene algunas otras preguntas, por favor avise y le contestare sin cargo adicional. Es MUY importante que entienda que si no está satisfecho, puede hacer preguntas adicionales sin cargo adicional. Por favor de NO usar las opciones "Necesito mas información" o "No respondió a mi pregunta." Simplemente responda con otra pregunta para yo tener la oportunidad de que usted quede satisfecho. Pero por favor también entender que yo no tengo la culpa si la noticia es mala. Yo solamente le puedo decir la verdad y no tengo responsabilidad por el sistema de leyes que a veces son injustas.
