Puede una persona reabrir su caso,sin tener que salir del pais durante los 2 anos que lleva elproceso, estando casada con ciudadano Americano y teniendo hijos nacidos aqui y viviendo en el pais 20 anos? Esta persona es de Peru, llego a los 18 anos y aplico por asilo politico, el cual fue negado. Nunca se presento en corte.

Solamente le pido dos cosas. 1) Si es mala noticia, no me culpe porque yo no tengo control sobre lo que dicte la ley y la verdad siempre es útil para evitar los ladrones en la calle que se aprovechan de la desesperación de uno para cobrarle miles de dólares en cosas que o tienen posibilidades mínimas, o no tienen posibilidades. 2) Dejar una opinión/valor positiva de mi servicio. Su pregunta no se cierra simplemente porque deja una opinión positiva. Estaré aquí para responderle sin cargo adicional.
Depende todo en como entro esa persona al pais. Entro ilegalmente o con visa? Cual visa?

Entonces si, es possible. Para poder pedir la Residencia ella tiene que solicitar un I-130 por parte del esposo Ciudadano y debe tener un I-247 listo por si la tratan de deportar en el entrevista (porque tiene orden de deporte). Entonces tiene que hacer una mocion con la corte que la deporto y tiene que convencer el fiscal o el juez de reabrir el caso de deportacion. Es MUY dificil de hacer porque ellos no estan requerido hacerlo. Es solamente si ellos piensan que ella lo merece. Si lo puede reabarir, entonces puede solicitar la I-485 adelante del juez. Si no, entonces no puede ganar la Residencia. Lo siento. Debe buscar abogado para que lo ayude reabrir su caso. Puede buscar uno en www.ailalawyer.com.
