Hello Lawyer,

An indian national did his MS in US, he is curently in OPT which is valid till March 2014,
another company has filed for his H1 and it was approved. Can that person go to stamping for his H1B in Canada in October 1st week 2013 ?
He would not have any paystubs by that time from the H1B petitioner company.

Hello,my name is Judith. Thank you for this opportunity to answer your questions.

Is he going to work for the H1B company when he comes back in Oct?

Customer: replied 3 years ago.

The consul will question why the visa applicant has not worked for the Herb employer under OPT.

There will need to be a reasonable explanation and may cause the application to be put into Administrative Processing while they investigate the company and the job offer.

Canada is not excited to have first time H1B applicants from out of their jurisdiction apply and when there is a questionable case, they can deny or put into AP.

This is not a guaranteed visa stamping.
