What happens if a US citizen fraudulently sponsors a non-US
What happens if a US citizen fraudulently sponsors a non-US citizen thru sham marriage and then self reports to ICE? The couple had had a business together and multiple financial business interests combined (thru their co-owned business at the time) as well as joined personal banking accounts and same personal address for the purpose of circumventing the immigration law, but never in fact lived together nor were a couple in any sense. Owning and running a business at the time was their only connection. The sponsoring US citizen never received any kind of compensation. Fraudulent marriage was entered into in 2008, then form I751 was NOT ever presented to or signed by the sponsoring US citizen, but was presumably filed with the authorities by the sponsored non-citizen, presumably in 2010, since the non-citizen was granted citizenship in 2012, approx. four years after the date of their marriage. The couple divorced shortly thereafter (2013). What is the statute of limitations for fraudulent marriage (I'm assuming that would be a criminal case) - is it five years? Also, what is the statute of limitations for filing I751 that was not presented to or signed by the sponsoring US citizen and how can this be proven? Would that also be a criminal or only an immigration only case? Correct me if I am wrong, but I presume there is no statute of limitations for immigration infractions, right? Can a US citizen in the case described above suffer any consequences, per criminal and/or immigration law or otherwise, given the timeline of events as provided? … read more
