I would get your veterinarian involved to do a soundness/lameness examination including evaluation of his neck and back. Depending on the results of this you will have a direction to follow.

Let me know if you have any questions

He looks a bit off on the left hind and his neck looks a bit stiff.

I would recommend getting your vet involved to perform a lameness exam, and likely inject his hocks.
As far as the neck is concerned, he/she could evaluate mobility and if needed Xray.

i dont want to spend alot of money on him if he is going to be too sore hurt or lame to ride and or use regularly the lady gave him to me for a reason and i am wondering if it was because he may have flipped or fell, do you suspect a xray would show the true reason for his discomfort and smaller hind end?
Horse Veterinarian: Dr. M., Board Certified Equine Surgeon replied 8 years ago
A lameness exam should be performed first, including flexion tests. And if the hind limb flexions are positives, the Xrays would definitely be indicated and worthwhile.
