Hello,

I am planning on moving to Germany where I have a position lined up as a postdoctoral researcher at Ludwig-Maximilians University in Munich. I am wondering about the certificate of conduct and whether my criminal record would prevent me from getting a work visa. All that I have read regarding the Schengen area and Federal Central Criminal Register suggests that it should not prevent me from getting a visa, but I want to be sure I have not overlooked anything. Some details of my record are below.
Date of offenses: October 1998, December 1998
Offense: Delivery of a controlled substance (marijuana) 1/8 oz and 1oz
I was sentenced for 6-23.5 months and served only approximately 115 days. I completed the remainder of the sentence on probation.
Will this show up on the Certificate of conduct and would this prevent my visa if it does show up? Any information you could provide would be greatly appreciated.

Thanks,
Matt

Dear customer,
thank you for using Justanswer.
No, this will probably be no problem for the residence permit.

a.merkel :

The General visa include e.g.: no reason of expulsion and no threat to the interests of the Federal Republic of Germany or the EU.

a.merkel :

So the Criminal history can play a role in this context.

a.merkel :

Your punishment is completely done since 15 years.

a.merkel :

Therefore, it plays no role today.

a.merkel :

You will receive a visa despite this criminal.

Customer:

Will this show up on the certificate of conduct?

a.merkel :

Thank you for your further question.

a.merkel :

This is depending on the regulations of your state.

a.merkel :

According to German law would the penalty be deleted after 15 years.

a.merkel :

If you were youth (under 18 years) at the time you did the delivery, after 5 years.
