If not, the process is a lot easier.In Virginia, your spouse must have "grounds" for divorce, if she doesn't have these, the process can get harder for her. Grounds include adultery, felony, cruelty, or separation (you would have to sign papers and live separately for 6 months-1 year if you all have kids).If the couple has no children from the marriage (including adopted ones), both spouses must have been separated for at least six months. In legal terms, separation means both spouses must have different sleeping arrangements and have no physical relations. In addition, both must sign off on a separation agreement. This document must clearly detail how they want to divide property and assets. If they can’t come to a conclusion, the court will step in.
