In the period that you lived in canada in 2011, you applied for benefits which normally are only available for residents. Did you continue to receive those benefits through the rest of the year or did you cancel them?

During the time you were in Canada, besides setting up a Cdn Bank account what other activities did you do? ie buy a vehicle, get CDN drivers licenses, rent and furnish a residence?
Customer:
Yes, I continued to receive those benefits through rest of the year and have not cancelled. Also, during my stay, I applied for the driving license in Greater Toronto Area and passed the G2 license test. I have already received my license card. however, I stayed with some friends in Mississauga and did not rent or furnish a residence.

I am a Mechanical Engineer working in a construction company.

Thank you. My concern here is that if you declare yourself as a non-resident in order to eliminate the need to file a Cdn tax return then it may jeopardize your landed immigrant status. Therefore if I was in your situation, I would file a Cdn tax return as a resident and then as you are working in construction abroad then claim the Overseas employment tax credit in order to minimize your tax liability.
