I assume by family allowance you mean Child benefit.

Situations like this are normally handled by complex claims team. Process is normally very very slow and it can take several months or even over a year to be resolved.

In a meanwhile you still accrue child benefit and it will be paid back once claim is resolved.

The only way you can resolved this is to obtain written statements from both parties and submit it to Child benefit office together with customer court orders. This might help.


Sadly in this situation you do not even have a right of appeal as there is no decision to appeal against.

If you are unable to obtain statements from both parties you should submit your statement and custody court orders and send to them recorder delivery.

I suggest you also call them at least every second week and ask for updates.

Bottom line is that it will take a long time whatever you do to get this benefit back.
