Morning: We entered into a contract with Pulte homes in Palm Beach Gardens, Fl on 1/13/20 to build a new home with them. A deposit of approx. $77,000. was made that date (10% of the approx. cost of the home). Construction started in early March; however, due to the pandemic, we are concerned that we cannot sell our current home to cover closing costs in July/August, 2020. Although the contract is clear that a Buyer's Default will result in all deposits being kept by the Seller (Pulte/Divosta), on April 2, 2002, they sent a mass email mailing to their client base, promulgating that the exact model we purchased is not 4% less (approx. $30,000.) This strategic action by Pulte has caused us to have a lower comp price when obtaining a mortgage as well as lowered the value of the current home WITHOUT MAKING A ALTERATIONS TO THE HOME TO JUSTIFY A NEW LOWER PRICE. If I remember correctly, a number of law suits were initiated in 2009-2010 against bulders for this exact practice as it created a price implosion to all homes in the community. Our question is: Do we have any legal recourse or will the builder (Pulte/Divosta) prevail and can just lower the price against new construction currently under way. Your advice please.
