How to oppose the judge lifting automatic stay. Santa Ana
Filed bk March 2 they file motion to lift stay March 9 mailed it March 11 we were going to file opposition March*****was closed and clerk advised us to mail it to la though courts in Santa Ana we mailed it and their attorney sent us two different court dates one for March 30 one for April 2. We had court call April 2 judge said that stay wasn't there anymore as of April 1 because our first bk was closed that we filed January 2 because we forgot to file counseling form. We tried to ask about the timeframe to oppose we thought we had 14 days plus three if mailed and hearing can't be scheduled earlier then 7 days. So we felt the hearing was misleading as they filed two different court dates. Judge said since stay was gone that the fourteen days didn't matter we asked to not waive the 14 day but she said since stay expired 30 days after we filed the 14 was irrevelant. We even overnighted our opposition we mailed to LA with counseling certificate and motion to impose/reimpose automatic stay but since it hadn't been received the judge said she was doing us a favor to verbally oppose … read more
