I have a question... so my husband and his ex wife been divorced 3 years now. aand on divorce decree it says they have joint coustdy ok and each parents claim on each kid. Because they have 2 sons together anyways my husband went to Over seas because he is in tbe military and he been gone for 15 months so the kids stayed with their mom eventho they have join coustdy my husband have to pay her child support and when he was going to oversea due to military. His ex wife went back to the family court to get more child support while he is gone and she asked the famoly court judge if she can claim on both kids on tax. And the judge said no, about that you have to go to the supreme court. Because its on divorce paper so anyways she didn't go to the court for that. And a year later she saying she is going to claim on both kids on tax return and we said no you can't because you didn't go to court for it. and i guess she been asking lawyers about it and they told her kids stayed with her more than 6 months so she can claim on that because divorce paper is only based on 50/50 coustdy but since the kids were with her a year she can so my question is. Can she just do that ? Without going to supreme court? Because she had kids over a year? … read more
