oops - hit enter too soon - I was named as the primary beneficiary on my ex-husband retirement accounts during our marriage of 34 yrs. Our divorce was amicable and due to the reasons for the divorce and our only daughter's troubled marriage, her father decided to leave me as primary beneficiary, knowing that the money will eventually be passed down to our daughter. This was done 14 yrs ago and discussed but he decided to leave as is especially when our daughter inherited money from her grandfather;s estate & wouldn't need to use retirement money. My ex-husband passed away in Sept, 2020, and had never remarried & unfortunately didn't list a contingent beneficiary. There were 2 annuity IRA's of which the insurance companies are refusing to release the funds to me. They both wanted copies of the divorce and Exhibit A - we did a Simplified Divorce for $389 and all assets were split and he kept his IRA & I mine (they were similar in value). The Exhibit A was a split of assets while he was living and didn't mention any death benefits or assets belonging to whom after death. The insurance companies are insisting the funds have to be paid to the estate and not to me. My ex husband wanted me to receive the money after his death because he had assets outside of his IRA's that was being left to our daughter. During 14 yrs of the divorce, this was discussed many times and he didn't want to change the beneficiary. Is there any hope of fighting this with the companies? Thank you, ***** ***** … read more
