I live in the state of Alabama - My daughter's father and I
my daughter's father and I were never married...he began paying child support in February 2004 in the amount of $559.00, he has always paid that amount - has been late a couple of times but he has maintained a consistent payment in that amount. My daughter turns 15 on September 18 that being said I filed for a modification in August of 2016 for an increase in child support - retained an attorney and have since requested her to withdraw from my case being that it is September 2018 and no action I'm no better off right now than I was in 2016. I honestly don't know what to do to get this resolved, I can not afford to retain another attorney. My question is - how far back in years can I go to ask for back pay? I recognize the case with my attorney was filed in 2016 and I don't want to close out that case I'm in the process of asking for a motion to compel and set a court date myself. My reasons for not having asked for an increase in previous years was out of fear, he threatened me with custody each time we went to court - both times I was the plaintiff - first in establishing paternity and getting things legally documented and the second time was because I married and relocated so the halfway point was different and he wouldn't meet me (that tells you how interested he was in being active in his daughters life)...so my (ex-husband) and I had to file for a modification to change the geographical meeting point and that case took over a year and a half to resolve so I was driving 2 hours each way every 1st and 3rd weekend. However - when I got divorced he had no issue in going back to the previous meeting location and stated to me verbatim the reason he wasn't willing to meet before was just to be an *sshole. … read more
