I have a child custody question. My sons grandma. In short,
In short, I am the non custodial parent. My son is 13. His grandma has legal guardianship of him since he was 5. I was deceived into signing some paperwork that I had no knowledge of what it had written on it. I understood by what my sons grandma told me that nothing would change with my time with my son, and all the paper stated was that my son's mom gave up her guardianship or parental rights to her mom. Because she didnt want my son to live with her any more. I wasnt in the best circumstances at that time to take him in with me.y sons grandma told me though that when my son was ready to go live with me she would let him go, no problem. So about 4 yrs ago I took my son's grandma (Rita) to court to terminate the guardianship and since she had a change of heart about her word she gave me. I was unable to because the judge asked me if I had a "legal" reason to terminate the guardianship and I had no idea how to answer that other than because I'm the father, isn't that enough..... I find out later how hard it is to terminate guardianship. Just a couple weeks ago my son (michael) tells me that they are going to move but they need to stay in a motel for two weeks until they find a spot to live because they had to already be out of the house they were at at that moment. Two weeks past and they had to get out of the motel and they have been staying at the old house which they are not supposed to be at in the house is empty in my son said they sleep on air mattresses. And he doesn't want to live like that. He was crying the other day that he wanted to stay with me because he doesn't want to go over there until there's a house but more so he wants to live with me, he's been wanting to. My question is how would I end would I be able to terminate the guardianship now that Rita does not have an actual home to live in with my son?… read more
