VerifiedHello. My name is ***** ***** I am a licensed Florida attorney. A simplified dissolution of marriage may be done as long as, 1) both parties sign the petition; 2) both parties attend the final hearing; 3) there are no children; 4) both parties agree to the division of assets and debts (Marital Settlement Agreement - including real property); 5) neither party is requesting alimony; and 6) both parties waive their right to a trial and an appeal.
You must list the husband's real estate on the documents or otherwise be open to perjury. There really is not a problem listing the property since both parties agree to the division or the asset. The marital settlement agreement may list it as the husband's sole asset.
Under Florida Rule 12.105, both parties may waive the Financial Affidavit requirement when filing for a simplified dissolution.
