Good morning:

That is primarily up to the mediator and your son. You do not have a legal right to attend mediation with him. Many mediators prefer that 3rd parties do not attend unless they are the attorney representing the parties. The mediator can set their own rules and refuse to allow non-attorney third parties if they desire. If the mediator allows it and your son doesn't mind, then there's no issue.

My son wants me to attend with him. What if it doesn't settle at mediation and we go to a hearing before the judge. Am I allowed to attend the hearing with my son?

You could attend as a spectator, unless the Judge for some reason cleared the chamber. The Judge ultimately controls who can and can't stay in their courtroom.

can I find out in advance if I can attend mediation or hearing with my son?

Your son can contact the mediator and ask them directly. As for the hearing, in most cases you should be able to. It would only be in extreme circumstances that you wouldn't, and that wouldn't likely be known until the hearing started.

I live in Florida, never married to my son's father. We separated when my son was only 2 years old. We owned a home together so we continued to live together as roommates until we short sold our home when my son was 5 years old. We did not want to get the courts involved so we just verbally agreed that my home would be the primary home and my son's father would only keep him every other weekend however he was able to see him anytime he wanted and could pick him up anytime during the week as long as he came home to me every night. We did that for about 4 and a half years until the summer of 2016 when my son's father informed me that he wanted to keep my son half the time once the school year started. I was completely against the back and forth of sharing my son during the school year but his father threatened to take me to court and I didn't want a judge telling us when we could see our child so I agreed to a 3/1/3 schedule. Mon. - Wed. with one parent, Thursday with the other, then Fri. - Sun with the other and we switch each week. My son at the time wanted more time with his father so that was the other reason I agreed to it. There's nothing in writing, just text messages and verbal conversations. My son now regrets wanting to go along with the shared custody and wants more time with me. He is also not doing well academically anymore although I can't be certain this is the reason but I would like to go back to my son staying with me while he's in school. His father refuses and says now that it doesn't matter what our son wants, he's his father and he wants 50/50. Is there anything I can do? … read more
