Customer Question

My husband and have been married for ten years. We individually created trusts because he came into the marriage with more assets. He worked for three years after we were married but I never received half of his earnings during our married years. He passed away two months ago and I would like to know if I am allowed to get 50% of his earnings while we were husband and wife.

Are you a beneficiary of his trust? Did he also have a will? Did he have any children, either with you or with anyone else? As his spouse, you would be a natural heir of his and therefore eligible for a spousal share. But exactly how much will depend on the answers to these questions.
