I am active duty military and my decree states I am primary custodian and my ex visitation. While I was stationed in Hawaii I deployed and my son went to stay with his dad in Texas in an attempt to not disrupt his school school he has stayed at his dads. I share joint legal custody with my sons father and I have primary physical custody, my son attends my sons fathers school district since he was in kindergarten, he is now in 3rd grade, I told my sons father we are moving to a different city that's 30 min away and my son would have to change schools since he lives with me, he disagreed on our son changing schools but did not disagree about us moving to a different city, we went to court last week and the judge ruled me as being defiant without asking the judge first to move and change schools. We have a trial in 3 weeks and my sons father is asking that my son stay in the same school and is now asking for 50/50 custody. What my question is, would it be a good idea to tell the judge we aren't moving after all and ask the judge for my son to switch schools in my city I am in now? Since my son lives with me?
