estoy con mi esposo ajuntada desde 1998 y de ellos casados legalmente desde el 2005,no tenemos hijos en comun,yo tengo una hija de 27 anos pero despues de tantos anos de convivir con mi esposo y teniendo yo p roblema de salud de hiperthiroidismo,ademas de una lunboartrosis y 50 anos que cumplo el prosimo mes y hacer solo 3 que emigramos para este pais y ser yo duena del caso por lo que se emigro mi esposo decide labarse las manos y terminar con migo ,los unicos bienes en comun son dos carros uno del 2000 y otro del 2007 que se compro a nombre de los dos,bien mi pregunta es la siguiente a que tengo derecho yo

En Indiana, propriedad esta distribuyido segun lo que el juez cree que es justo. Normalmente, la division de propriedad y deudad es igual, pero en algunas circunstancias, la corte puede dividir la propriedad y deudas en una manera diferente. En decidir como dividir la propriedad, la corte necesita considerar estes factores:

Si el tribunal decide que uno de los cónyuges está incapacitado física o mentalmente de una manera que afecte sustancialmente a la capacidad de dicho cónyuge para ser autosuficiente. En ese caso, el apoyo dura por el tiempo que dure la incapacidad, y la Corte se reserva la posibilidad de cambiar el orden después.

Si el tribunal considera que uno de los cónyuges no tiene suficiente propiedad, incluso después de que los bienes gananciales se divide, para satisfacer las necesidades de ese cónyuge, y que su cónyuge tiene la custodia de un niño que tiene una incapacidad física o mental que significa que el padre puede "trabajo t. Ambas cosas deben ser ciertas. Con este tipo de mantenimiento, el tribunal puede ordenar el apoyo para cualquier período de tiempo que el juez piensa que es apropiado.

nosotros no tenemos hijos en comun ,mi pregunta esta basada en tengo yo derecho a algun tipo de indernisacion por los anos de casados ,tener yo 50 anos y presentando problemas de salud que ya son una patologia que a corto o largo plaso me ban a impedir trabajar y el tiene 42 anos y es un hombre saludable, en cuanto a los carros eso no me preocupa,pero si al tiempo del divorcio yo tengo que dejar el trabajo por rasones de salud ya el no tendria obligaciones para con migo por fabor nesecito una respuesta

Mi respuesta explique sus derechos sin ninos. Cuando digo "mantenemiento," quiero decir para usted, no para ninos. Y division de propriedad es igual con o sin ninos.

Si la corte decide que usted esta incapacitada, es posible que usted podria recibir dinero para usted ("alimony"). No hay ninguna ley diciendo cuanto recibiria - dependeria en la decision del juez.
