He wishes to stay with us because his mother has a different boy friend about every two years.He wish not to stay with her

Does the mother have court ordered custody?
Is there a father involved?
Does anyone pay child support?
Is the mother refusing to allow the child to live with you?
The reason I need the information is that a child cannot simply decide to leave his parent and move to another family member's home so I need the information so I can tell you what need to be done in order to get the child to be able to legally move.
