You need to get a grant of temporary guardianship
through the courts in most cases because the schools will want a court order of guardianship to allow you to act on the child's behalf. You would file a petition for guardianship together with an affidavit from the father who would sign stating he is agreeing that you may have guardianship over the child. In order for the father to prevent contact or giving the child back to the mother, because there is joint custody, he would have to go to court as well with a motion to modify custody to get the court to issue an order stating you cannot give the child back to the mother. The two of you, since your interests are the same, the best interests of the child, can use one family law
attorney to do all of this and keep the costs at a minimum by sharing the legal costs of these filings.
