I live in california, my ex got half my retirement yet she is working. Why does this happen, is this right?

Your ex received half your retirement because she must have been married to you during the time that retirement fund was accumulated. According to Federal law, that's the only criteria. It doesn't depend on someone being out of work or anything else. For instance, if your getting the other half of the retirement, you can work if you want to, also.
