Your brother can move out of his parents home if he is emancipated.


A child can become emancipated prior to the age of 18 with the written or implied consent of the parent(s). Consent can be implied by the parent’s acting or failing to act to govern or support the child or allowing a child to move out and become self-supporting. A person under the age of 18 may also become emancipated by court order.
