Hello,

If your wife were to die, the debt would still be owed to her estate. The executor of the estate or a beneficiary could continue legal actions to collect the debt. The same legal action would continue. The name of the party would simply change.

I hope this helps!

Many States do not allow forced sale of a homestead in order to collect a debt. The lien is only there so that if the owner sells the house, you can get paid from the proceeds.

If you want to resolve this matter quickly and with minimal hassle to your family (it sounds like you are dealing with enough with your wife's health problems) you may want to consider hiring a professional collector. Many attorneys specialize in this, or you can consider a child support collection professional like this site:

A professional will like keep as a fee a percentage of what is collected, but at least you get a large chunk of the debt and don't have to deal with the collection efforts yourself.

Good Luck.
