My mom passed away in 1989.my father remarried 6 mos later, moved to Florida, bought a . money used for purchase was from sale of our family home in nj passed down (sold) to my mom from her family. There was a will but none of her 5 kids knew what was was in it. Jewelry and personal effects distributed to kids several years later.New wife has 2 older adult children that never lived with her.My dad has a will and he is 88. it was changed twice to include her 2 kids. My brother is executor.Florida law is different. So question is, does his General Motors pension which pays everything in the household, is she entitled to that or does it depend on how its written in will ? and her children should not be entitled to that, correct?. also, her money was never used toward household and strickly put into investments and accts and her kids are the beneficiaries. of those. Is communal property law in Florida? Lastly, if he passes it states sale of the house goes to 7 kids, however not until she passes. Can she sell house and if she does is that when money is disbursed? and if he passes is that will void?… read more
