I have a real estate / inheritance question. My husband's
My husband's sister is in a nursing home. Her husband died a few years ago. Prior to his death, he was in a nursing home. My sister-in-law owed her husband's nursing home a balance of $7,000. The nursing home went after the balance and took her to court. By this time her health had failed and she did not follow through to pay the bill. By then she was in a nursing home herself and her husband's nursing home wanted to sue her husband's estate for the $7,000 balance.The court appointed an Executor. It is important to note that her husband had a house that they lived in for years but did not leave a Will or include her on the deed to the house. He had a son but did not include him on the deed either.My husband is the only other living relative that his sister has other than the stepson. To date, the Executor's fee is $10,000 and the nursing home's fee is $7,000. If my husband pays off the $17,000, can his sister put him on the deed instead of herself. Otherwise, her nursing home could take the house from her because it will become and asset.How can my husband avoid the nursing home from taking the house as an asset while it is still in control of the Executor? What are my husband's and his sister's alternatives.She has a CD that my husband is waiting to receive. He plans to cash in to payoff her debt. He is her Power of Attorney. Can he do that without penalty?Please advise what my husband should do to get the deed in her name or his name? Also, is his son entitled to anything from his estate?
