I am in the following situation: My father died six years
My father died six years ago. When he died, he created a trust that would provide for my stepmother's needs, with all money remaining after she died going to his descendants. My stepmother ran out of money quickly, so that trust has provided for her for the last five years. We are about to sell the family house, and my stepmother's trust will acquire half the proceeds of the house. That will be enough to pay for my stepmother's care for the foreseeable future. Question: if there are two trusts that can provide for my stepmother, which one pays: the one in her name, with her kids as beneficiaries, or the one in my father's name with myself and my siblings as beneficiaries? What is the pertinent law? I live in Maryland, incidentally. My stepmother's kids live in DC. My stepmother lives in Maryland. … read more
