My mother past away July 2015 and left my eldest brother in charge of her estate. They live in Illinois as did my mom. At first my brother said according to her WILL he was to dispense my money as beneficiary on as as needed basis, as well as for my children. He sent some money for dental work I needed but each time I asked to see the will he had an excuse. Last month he said he just wanted me and my children to have our inheritance as see felt my xhusband was out of the picture and did want to protect us all from him trying to get the money. However, he still refused to send me a copy of the will. He then stated it was a trust. I asked for a copy of the accounting. He refused. I said I was setting up my own trust since my son is special needs and receives some Mass. state benefits and I did not want him to lose the benefits. I asked for my brother to wait to write the checks to my soon to be established trust. He instead just sent checks from a personal account in his name and my mothers name. I said I needed to see the trust. He said according to Illisnois law my mothers assets were less than 1000. for probate. However he sent a 60K check. He said Illinois law says he does not have to disclose anything about the trust. I think Im being deceived here. Is this law true? … read more
