Answer - The short answer is that you must establish the trust prior to your passing. If you are having a "testamentary trust" created in your will, the will would have to be probated in order to fund the trust. However, since you are wanting to avoid probate, you will need to establish the trust prior to you passing. While you can create a trust using do it your self forms, if you do not properly transfer the trust property into the trust, the trust documents will be worthless, so you will want to work with a qualified trust attorney.

The cost will be between $2,000 and $4,000.00 depending on the complexity of your estate.
