VerifiedThe purpose of a living trust is to avoid the probate process. Without it, you have to go through probate, which is the process of the court approving of the Will and watching over you a bit while you execute it. The court will also give you the permissions you need to transfer property.
A PoA is only good during the person's lifetime and does not survive their death.
You don't need a lawyer to do probate. The probate court will have a web site telling you what you need to do and all the forms you need. If you are still confused and don't want to hire an attorney, get a good "how to" book; NOLO is probably the best for those kinds of guides.
Not sure what you mean by the "automatic probate"; if there is a Will and real estate then you need the court to give you authority.
